Whether you’re going out with co-workers after a long day, meeting a friend for dinner or attending any sort of social gathering, there is a very good chance that alcohol will be consumed at some point during the course of the evening.

While there is certainly nothing wrong with having some wine, cocktails or beer over the course of the evening, it’s important to drink in moderation, particularly if you plan on driving.

Indeed, this doesn’t just mean you should avoid heavy drinking, but also consuming that one extra drink, as it may be enough to put you just over the blood alcohol content of .08 and in line for a first-time DUI arrest.

In case you need extra motivation to opt for coffee or water before last call, keep in mind that Florida law dictates some very harsh consequences for drunk driving, even first convictions:

  • Fines: Anywhere from $500 to $1,000, with these amounts rising to anywhere from $1,000 to $2,000 if a minor was present in the vehicle, or BAC was .15 or higher.
  • Community service: Mandatory 50 hours of community service.
  • Incarceration/Probation: Up to six months, with this time rising to up to nine months if a minor was present in the vehicle, or BAC was .15 or higher (Sentence may be served in treatment program and terms of probation/imprisonment cannot be longer than one year.)

At the Umansky Law Firm, we understand that mistakes can and do happen. That’s why we are so committed to protecting the reputation, preserving the freedom and enforcing the rights of every client arrested for a first-offense DUI — and subsequent DUI offenses.
