Probation in Different Counties
In the question of “can you be put on probation in separate counties?” the answer to that question is actually yes, and there are some different ways those cases will be carried out. If you were looking at felony cases, and you’re going to be put on probation in multiple counties for felonies, normally the Department of Corrections (felony probation) will consolidate everything under one county, which will be the one in which you live. You will be on probation and have supervision out of that one county, but the other counties will retain jurisdiction if you violate that probation.
If you are on misdemeanor probation, normally in the State of Florida, misdemeanor probation doesn’t transfer, meaning everything, including supervision and jurisdiction to sentence you if you violate that probation, all remains in the home county. However, you can be on multiple probations. For example, you get a case in Orange County, and you also get a case in Brevard County. If it works out time wise and you are sentenced close together, you can be on concurrent probation. Some attorneys will set up the sentence in a way that there is no confusion, but all of the prosecutors and the judges know that this probation is going to be served at the same time so that the client would be given credit for both or multiple probations during this same time.
What To Do If You’re Facing Multiple Probation Terms?
Sometimes prosecutors will move against this and say they want the probations served consecutive to the probation that is already being served in the other county. This happens very rarely; prosecutors don’t typically push for that. However, if that’s the case, you’ll serve the probation in the first county, and then you will transfer and start serving probation in the second county. Many times, the judges or prosecutors will put you on what is sometimes called “concurrent terms of probation”, so that you’re basically taking care of both cases at the same time.
