“Resisting” Law Enforcement Charge Dismissed on Trial Day

Case Number: 2025-MM-403371-A-O
Charges: Resisting without violence
County: Orange

On March 20, 2025, around 1:45 a.m., Orlando Police claimed to smell cannabis and ordered our Client and another person to “show some ID.” When the other individual ignored them and walked inside an apartment, officers ordered our client to stand up. He complied—but as he turned to place his phone inside, he was suddenly tackled and accused of “resisting law enforcement” by allegedly running away and resisting handcuffs. We immediately challenged the legality of the encounter, showing that no lawful command had been given and that officers cannot use the mere smell of cannabis to justify such actions. We prepared for trial, and on the morning it was set to begin, the State dismissed the case entirely.
