Client was arrested for two separate second-degree felonies for sale and delivery of cocaine. Under the statute, a withhold of adjudication is rarely permitted on even one of these charges, yet we successfully negotiated a withhold on both. The State initially demanded felony convictions, one year of house arrest with an ankle monitor, and additional probation, but we secured straight probation only. After reaching that agreement, we also convinced the judge the sentence was legally permissible, and it was accepted. Client, a small business owner who feared losing his livelihood, avoided both house arrest and felony convictions, allowing him to keep his business and move forward with his life.
