Client had recently separated from her long-term boyfriend of nine years, although they were still living together in the home they jointly owned. An argument began over what would happen with the house. During the dispute, the boyfriend held his phone and threatened to call 911. Client said she would call for him and reached for the phone, at which point he shoved her. She instinctively shoved him back — the basis of the alleged battery. Because the boyfriend shoved her first, Client’s response was a clear act of self-defense. After the attorney presented the circumstances and lawful justification for her actions, the State dismissed the case entirely — fully clearing Client of the charge.
