Client’s ex-girlfriend, with whom he shares a child, claimed he came home after an argument, choked her, and threatened her with a gun. In truth, she attacked him first—punching, choking, and jumping on him—until he pushed her off and held her down to stop the assault. She later changed her story and filed charges. Client was charged with aggravated assault and battery by strangulation. The attorney negotiated a resolution where the aggravated assault was nolle prossed and client pled to simple battery, receiving 12 months probation, no alcohol or weapons, BIP, and 30 community service hours.
