Client was a passenger during a traffic stop where the driver admitted the drugs in the car were hers. During a pat-down, officers found a concealed firearm under Client’s shirt. The State charged Client with Carrying a Concealed Firearm. Attorney filed a motion to dismiss, explaining that the firearm was “securely encased” because the holster had a snap strap over the gun, meaning no concealed firearm permit was required. The State conceded the legal issue and dismissed the charge before the hearing.
