Outcomes: Our client was arrested for a DUI following a crash. When the cops arrived, she was asleep behind the wheel and could not stay awake. They did not smell alcohol, but thought our client may be on drugs. They took the client’s blood and it showed the presence of temazepam, which is a sleeping medication. We hired an expert witness and filed a motion to exclude the blood results. The judge granted our motion, leaving the state with no real evidence other than the client being incredibly sleepy behind the wheel. We set the case for trial and the State dismissed the charges.
