Client was arrested for his third DUI within ten years. We devised a plan with Client to resolve his case with a plea deal as quickly as possible because of the likelihood he would be upgraded to a third-degree felony. Client agreed. We were able to negotiate no jail and first-time misdemeanor penalties for this third DUI that should have been a felony. Although Client will have to deal with the DMV’s wrath when they find out he has three convictions, he was able to avoid an inevitable felony conviction and serious jail time—two things he greatly needed to avoid.
