Elderly client has been robbed before, and was driving convertible BMW on highway when a car tailgates him for miles, then eventually pulls up beside him. Client points a “gun” (turns out to be BB gun) at the other driver, who turns out to be a police officer in unmarked car. Client arrested and charged with aggravated assault and drug trafficking (for drugs in trunk). Our Attorney proved the this cannot be aggravated assault as you cannot fire a BB gun through two closed windows and it’s not trafficking as the weight under 10 grams. Client was able to plea to a lesser charge of “assault” (misdemeanor) and possession of controlled substance. State originally wanted 30 years prison and client was able to walk away with no felony conviction and commuinty service thanks to his legal team.
