Client was arrested after Orlando Police claimed a “vape pen” found in his car contained THC resin. Although the device actually belonged to his sister—the passenger who had been seen holding it—officers charged the Client with felony possession of cannabis. Attorney immediately began preparing to challenge the State’s flawed interpretation of the statute and the basis for the arrest. Before the motion could even be heard, the State reviewed the evidence and dismissed the case outright, recognizing that OPD’s own observations proved the Client was not responsible. The Client avoided a felony charge and maintained a completely clean record.
