On November 22, 2024, the 70-year-old Client was arrested after a traffic incident with an undercover officer and charged with Assault with a Firearm and Drug Trafficking when troopers found roughly 10 grams of a controlled substance in his car. The Florida Highway Patrol also attempted to seize the Client’s $40,000 convertible BMW. Our attorney successfully challenged the forfeiture at the probable-cause hearing, arguing that the alleged drug weight included packaging and that the car’s value made forfeiture unconstitutional under the Eighth Amendment. The court ordered attorney’s fees against FHP, which then voluntarily dismissed the forfeiture action. The Client kept his vehicle and avoided a trafficking conviction.
